We may modify this Privacy Policy, and if we make material changes to it, we will provide notice through our Services, or by other means, to provide you the opportunity to review the changes before they become effective. Your continued use of our Services after we publish or send a notice about our changes to this Privacy Policy means that you are consenting to the updated Privacy Policy.


1. Information We Collect

General

When you use our Services, you may be asked to provide and we may collect personal information which may uniquely identify an individual. Examples of this information include your name, email address, mailing address, phone number, credit card or other billing information. Personal information may also include information such as your date of birth, geographical location, or preferences.

We may acquire personal information about you from third parties, including but not limited to payment information, travel information, and background check information, and link that information to the personal information we collect.

As you use our Services, Lyric may also collect information through the use of commonly used information-gathering tools, such as cookies and web beacons, as well as standard information from your web browser (such as browser type and browser language). Our Cookie Policy describes our use of cookies and other web-tools.

We use data for analytics and measurement to understand how our Services are used. For example, we analyze data about your visits to our websites to do things like optimize product design. We use a variety of tools to do this, including Google Analytics. When you visit sites that use Google Analytics, we and Google may link information about your activity from that site with activity from other sites that use our Google Analytics services. We may combine the information we obtain through use of cookies and web tools with the information we collect directly.

If you participate in community blogs or commenting features on our websites, we will collect your contact information and the other information you submit. This information, including your contact information, may be viewed by others who visit these forums. We are not responsible for the personal information you choose to submit in these forums and may delete or correct it at any time.

If you opt-in to particular features in our Services, we may also collect geographic and location information to provide product functionality. These features are specially identified in our Services.

We collect your billing information in connection with credit card payments initiated by you.

We collect your resume or C.V. when you apply for a job with us.


Information Collected - Lyric

When you make a reservation with us, we collect your name, email address, physical address, telephone number, date of birth, and your purpose for travel. When you create an account with us, we collect and store the same information.

Through our “Share Your Reservation” feature option in our Services, we also collect personal contact information, such as the name and e-mail address of the individuals you choose to share your reservation with.

Please note that if you give us personal data on behalf of someone else (or someone else gives us personal data on your behalf), the person providing the personal data must have consent or other legal basis to do so. Information Collected - Wheelhouse

When you create an account with us, we store the address of your listings, your booking information, and your contact information. In addition, we encrypt your username and password for your connected listing accounts (such as Airbnb). We will also collect and store your booking data.


2. How We Use Information Collected

General

How we use your personal data will depend on the Services you use, how you use those Services, and the choices you make in your settings. We use the data that we have about you to provide, support, personalize and make our Services more relevant and useful to you and others.

When you access the Services, we use your data to authenticate you and authorize access to our Services. We will also use your data to provide you with the information about the Services. If you register to attend one of our events, we will use your personal information to authorize your attendance at the event provide you with information about the event.

We may also your personal information to contact you about products, services, or events that may interest you. For example, we may use your personal information to contact you to further discuss your interest in the Services or promote engagement with our Services.

If you pay us for Services by credit or other payment card, we use your billing and payment card information solely to check your financial qualifications and collect payment from you.

We use your resume and C.V. to evaluate your candidacy for a job with us.

We also use personal data to fulfill our contractual obligations, for our legitimate interests, or when we have a lawful basis to do so.


Social Media Features

Our websites may use social media features, such as the Facebook “like” button. These features may collect some information about your use of our website. You may be given the option by social media providers to post information about your activities on our website to your profile page or on our site.


3. How We Share Information We Collect

We do not share, sell, rent, or trade any of your personal information with third parties except as described in this Privacy Policy.

Service Providers

We share your personal information with service providers to enable our service providers to provide you with services on our behalf. We contractually restrict our service providers to use your personal information only as necessary to provide services to us.

Affiliates

We share information within our corporate family. For example, we may need to share your personal information with one of our subsidiaries in order to provide you with technical support or account management purposes in your region.

Business Partners

We may partner with other companies, such as our cloud provider partners, to jointly offer products, services, or programs (such as webinars or downloadable content). If you purchase, specifically express interest in, or register for a jointly offered product, service, or program from or through us, we may share your personal information with our partner.

We will also share information with our partners and event sponsors if you specifically opt in to such sharing via an event registration form or attend an event and allow us or our partners to scan your attendee badge.

We do not control our partners’ use of your personal information. If you do not wish for your personal information to be shared in this manner, you may opt not to purchase or specifically express interest in a jointly offered product or service.

Billing

Lyric uses a third-party service provider to manage credit card processing for our Services. Our service provider is contractually prohibited to store, retain, or use your billing information except for the sole purpose of credit card processing on our behalf.

Compelled Disclosure

It is possible that we will need to disclose information about you when required by law, subpoena, or other legal process or if we have a good faith belief that disclosure is reasonably necessary to (1) investigate, prevent, or take action regarding suspected or actual illegal activities or to assist government enforcement agencies; (2) enforce our agreements with you, (3) investigate and defend ourselves against any third-party claims or allegations, and (4) protect the security or integrity of our products and services (such as by sharing with companies facing similar threats). We attempt to notify customers about legal demands for their personal data when appropriate in our judgment, unless prohibited by law or court order or when the request is an emergency. We may dispute such demands when we believe, in our discretion, that the requests are overbroad, vague or lack proper authority, but we do not promise to challenge every demand.

Change of Control

We can also share your personal data as part of a sale, merger, or change in control, or in preparation for any of these events. Any other entity which buys us or part of our business will have the right to continue to use your data, but only in the manner set out in this Privacy Policy unless you agree otherwise.


4. Children's Privacy

Our websites and marketing are not directed to children under 13 years of age. We do not intentionally gather information about visitors who are under the age of 13. If our practice changes, we will obtain consent from a parent or guardian before we knowingly collect PII from anyone under the age of 13.


5. International Transfer of Information Collected

We primarily store your information in the United States. To facilitate our global operations, we may transfer and access such information worldwide, including from other countries in which we have operations. We store your information in accordance with the data retention periods set forth in the terms of service or for as long as otherwise consented by you.

Lyric makes available a Data Protection Addendum to customers of the Services with personal data originating from the E. U., which includes the E.U. Model Clauses, also known as Standard Contractual Clauses. To request a copy of our Data Processing Addendum, incorporating the E.U. 6. Correcting and Updating Your Personal Information; Changing Your Preferences

We may retain your personal information for a period of time consistent with the original purpose of collection. For instance, we may retain your personal information during the time in which you have an account to use our websites or Services and for a reasonable period of time afterward. We also may retain your personal information for as long as we need it to conduct audits, comply with our legal obligations, resolve disputes, and enforce our agreements.

You may request to review, correct, delete, or otherwise modify any of the personal information that you have previously provided to us.

Marketing

We may use your personal information for invitations and communications promoting our Services. You may opt out of receiving all emails selecting the ‘Unsubscribe’ link in these marketing emails.

User and Account Settings

If you have registered for an account with us, you may update your user and account settings by logging into our website or Services with your username and password and editing your settings.

Billing Information

To update your billing information or request return or deletion of your account information, please contact your account representative.

Our safeguards are not a guarantee against the loss, misuse, or unauthorized access, disclosure, alteration, and destruction of your personal information. In addition, we use standard security protocols and mechanisms to transmit sensitive data such as passwords and credit card details.

Type of Cookies

Targeting or Advertising cookies

Lyric sometimes uses cookies delivered by third parties to show you ads for Lyric products and services that we think may interest you on any devices you may use and to track the performance of Lyric advertisements. For example, in these cases, cookies remember information such as which browsers have visited Lyric’s websites. The information provided to third parties does not include personal information, but this information may be re-associated with personal information after Lyric receives it. If Lyric is using one of its own cookie-related products on our own Lyric website, then a cookie related to ads may appear on our website under the Lyric name.

Lyric also contracts with third-party advertising networks that collect IP addresses and other information from web beacons (see below) on Lyric’s websites and Services, from emails, and on third-party websites. Ad networks follow your online activities over time and across different sites or other online services by collecting Website Navigational Information through automated means, including through the use of cookies. These technologies may recognize you across the different devices you use, such as a desktop or laptop computer, smartphone, or tablet. Third parties use this information to provide advertisements about products and services tailored to your interests. You may see these advertisements on other websites or mobile applications on any of your devices. This process also helps us manage and track the effectiveness of our marketing efforts. Third parties, with whom Lyric partners to provide certain features on our Lyric’s websites or to display advertising based upon your Web browsing activity, use Flash cookies to collect and store information. Flash cookies are different from browser cookies because of the amount of, type of, and how data is stored.

Web Beacons

Lyric uses web beacons alone or in conjunction with cookies to compile information about Visitors’, Customers’, and Attendees’ usage of Lyric’s websites and interaction with emails from Lyric. Web beacons are often-transparent graphic images that can recognize certain types of information on your computer, such as cookies, when you viewed a particular website or Service tied to the web beacon, and a description of a website or Service tied to the web beacon. For example, Lyric may place web beacons in marketing emails that notify Lyric when you click on a link in the email that directs you to one of Lyric’s websites. Lyric uses web beacons to operate and improve COMPANY’s websites, Services, and email communications.


Log Files, IP Addresses, URLs, and Other Data

As is true of most websites, we gather certain information automatically to analyze trends in the aggregate and administer our websites and Services. This information may include your Internet Protocol (IP) address (or the proxy server you use to access the World Wide Web), device and application identification numbers, your location, your browser type, your Internet service provider and/or mobile carrier, the pages and files you viewed, your searches, your operating system and system configuration information, and date/time stamps associated with your usage. Due to Internet communications standards, when you visit or use Lyric’s websites and Services, we automatically receive the URL of the website from which you came and the website to which you go when you leave our Website. This information is used to analyze overall trends, to help us improve our websites and Services, to track and aggregate non-personal information, and to provide the websites and Services. For example, Lyric uses IP addresses to monitor the regions from which Visitors, Customers, and Attendees navigate Lyric’s websites. Lyric also collects IP addresses from Customers when they log into the Services as part of Lyric’s “Identity Confirmation” and “IP Range Restrictions” security features.


Do Not Track

Currently, various browsers — including Chrome, Firefox, and Internet Explorer, and Safari — offer a “do not track” or “DNT” option that relies on a technology known as a DNT header, which sends a signal to websites visited by you about your browser DNT preference setting. We do not currently commit to responding to browsers' DNT signals with respect to our websites, in part, because no common industry standard for DNT has been adopted by industry groups, technology companies, or regulators, including no consistent standard of interpreting user intent. We will continue to monitor developments around DNT browser technology and the implementation of a standard.
